Proposed legislation that may effect home education.
SB 5142 would prohibit school districts from advertising and marketing alternative learning programs as home-based instruction. Requires school districts give parents full disclosure of the difference between alternative learning programs and home-base instruction.

This bill was introduced by CHN. SB5142 was reintroduced from the 2011 Legislative session where it passed the Senate unanimous. In the House it failed to meet the deadline to pass out of committee. SB5142 starts the process over.
At the 2011 hearings CHN passed out notebooks “Fast Facts on ALPs” which included a list of concerns with Parent Partnership Programs. CHN and Christian Heritage Home Educators testified at the hearings in support of this bill.

HB 2199 Lowering the compulsory school age to 6 or 7.

CHN opposes this bill on the principle that parents should be able to decide when their child is ready for formal education.

HB1633 lowering the compulsory school age to seven. (bill is dead, see HB2199)
SB 5346 and 5848 allowing for education vouchers. Parents who chose to educate their children outside of the public school system may apply to OSPI for a $3500 voucher. Child must pass a national assessment.

CHN does not support vouchers, due to the “strings” attached. Other issues of concern with this bill; Federal law exempts homeschool students from taking a national assessment, religious schools/teaching cannot receive state monies.

Bills that Would Threaten Parental Rights
HB 2193 Allowing a third party (non-relative) to petition the court for visitation of a child. This bill would enact a new section in Washington law that would allow any person to petition a court for visitation rights with a child if they have “established an ongoing and substantial relationship with the child.” HB2193 is not limited to grandparents/relatives but is open to non relatives.

Once the petitioner demonstrates that the child will likely suffer harm or there is a substantial risk of harm if visitation is not granted the burden effectively shifts to the fit parent to "prove why their decision to deny visitation is reasonable and in the best interest of the child." We believe this is a clear violation of the presumption that fit parents are making decisions in the best interests of their children and their fundamental right to direct the care, custody, and control of their children.

Note: This is the same bill CHN was able to defeat in the 2010 legislative session (HB2124)
CHN testified against this bill on 1/11 in the House Judiciary Committee. At the hearing, Rep. Shea questioned the individual who lobbied for the bill. As result, Rep. Shea was able to confirm that GOP members that signed on to the bill were misinformed.

HB 1442 Requiring parental notification before an abortion.

HB1602 Restoration of parental rights act.

HJR 4215 Amend the Washington State Constitution to include parent’s rights. The liberty of parents to direct the upbringing and education of their child is a fundamental right.

Other Bills of Interest
HB 1537 Allowing for parent taught drivers education. This bill would allow for parents/guardians to teach an approved commercial drivers education course at home versus enrolling youth in a commercial driving school. Under current law it is mandatory for a youth under the age of 18 years of age to have completed a traffic safety course from a commercial driving school.

We would like to reiterate that this proposed legislation does not just benefit homeschool students but benefits all students as an option to the commercial driving schools.

HB 2209 Regarding ALE accountability. The main purpose of this bill is to remove Contract Programs, that serve at-risk high school students from funding cuts to ALEs (HB2065 2011). CHN is monitoring this bill to ensure there is no confusion with HBI and ALE.

Other Bills of Concern
Passed into law: SB 6239 allowing for homosexual marriage. This act would redefine marriage as more than one man and one woman and allow for couples of the same sex to marry. Governor signed on 2/13/12.
